PLEASE READ THESE TERMS OF USE FOR THE SOL Committee DIGITAL CLUB CARD PROGRAM CAREFULLY. BY ACCESSING OR USING THIS PROMOTIONAL PROGRAM, YOU AGREE TO BE BOUND BY THE TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT PARTICIPATE IN THIS PROGRAM.

These Terms of Use apply to your access to, and participation in, The SOL Committee Digital Club Card program (“Digital Club Card”). These Terms of Use do not alter in any way the terms or conditions of any other agreement you may have with The SOL Committee for products, services or otherwise. The SOL Committee reserves the right to change, modify and/or terminate the Digital Club Card and/or these Terms of Use or any policy, FAQ, or guideline pertaining to the Digital Club Card at any time and in its sole discretion. Any changes or modifications will be effective immediately upon posting the revisions to this page, and you waive any right you may have to receive specific notice of such changes or modifications. Your participation in the Digital Club Card confirms your acceptance of these Terms of Use and any such changes or modifications; therefore, you should review these Terms of Use and applicable policies from time to time to understand the terms and conditions that apply to the Digital Club Card. If you do not agree to the Terms of Use, you must stop participating in the Digital Club Card.

The Digital Club Card is not targeted towards, nor intended for use by anyone under the age of 18. If you are between the ages of 13 and 18, you may only use the Digital Club Card under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use.

Please read the Privacy Policy carefully to understand how The SOL Committee collects, uses and discloses information about its customers.

The SOL Committee reserves the right to terminate your account and/or your participation in The SOL Committee Digital Club Card Program if The SOL Committee determines in its sole discretion that you have violated these Terms of Use, or that the use of your account is unauthorized, fraudulent or otherwise unlawful.

The SOL Committee reserves the right to terminate, discontinue, modify or cancel The SOL Committee Digital Club Card Program at any time and in its sole discretion without notice of Digital Club Card holders.

This SOL Committee Privacy Policy ("Policy") describes how SOL Committee uses and discloses personal information of customers collected through our websites and online services, including https://solcommittee.com, SOL Committee Club Card, and other SOL Committee owned or operated websites and online services that link to this policy (collectively, the “Sites”), through our programs and in our physical SOL Committee stores ("Services"). This Policy does not apply to websites and services that display or link to different privacy statements. Websites and services co-branded with other partners may display or link to a joint privacy statement or separate privacy statements of our partners in addition to our Policy. By accessing the Sites or utilising the Services, you hereby consent to the use of your information, including your personal information, any information of others provided by you, in the manner described in this Policy. Without limiting the generality of the foregoing, you authorise SOL Committee to transmit your information outside Hong Kong in the manner and for the purposes described in this Policy. 

What Type of Information Does SOL Committee Collect?

Personal Information that may be collected by SOL Committee may include:

• First name, family name, postal address, phone number, and e-mail address.
  
• Financial account information, such as credit card number and other payment information.
  

We may also collect information about you or others as you provided such as:

• If you create a Club Card – your birthday, gender and mobile phone number.
  
• If you buy goods at our stores or through our programs or otherwise – what you buy, where you buy, how frequently you buy, rewards you earn, and rewards you redeem.
  
• If you buy and send any SOL Committee eGift – name and e-mail address of the recipient you selected from your phonebook; and you accept all liabilities in relation to the provision of such information to us for forwarding the eGift in accordance with your instruction.
  
• If you register, activate and add a SOL Committee Club Card to your eWallet – the card number, card transactions, loading value to SOL Committee Club Card, redeeming any value, balance transfer, balance enquiries, device ID, your locations and stores near you and visited by you.
  
• If you take a survey or interact with us in various other ways – demographics information, your comments, feedback, questions or suggestions, and information about subjects that may interest you.
  

Automatic data collection via Cookies

We may automatically collect online use information when you visit our Sites. This information may include information about your Internet service provider, your operating system, browser type, domain name, Internet protocol (IP) address, your access times, the website that referred you to us, the Web pages you request, and the date and time of those requests. Our collection of online use information may involve the use of cookies. Cookies are small data files stored on your hard drive by a website. Among other things, cookies help us improve our Sites and your experience. We use cookies to see which areas and features are popular and to count visits to our Sites.

SOL Committee may also collect aggregated data or anonymized data that does not directly identify you.

We may combine information we collect about you with information we receive from third parties.

How Does SOL Committee Use Information About You and Others that you provided?

SOL Committee may use information about you or others that you provided for purposes described in this Policy or disclosed to you on our Sites or with our Services. For example, we may use information about you or others that you provided to:

• Process and manage your purchase and use of SOL Committee products and services, including your accounts and program participation, your use of the Sites.
  
• Respond to your customer service inquiries, post your comments or statements on any blog or other online forum maintained on our Sites, or take other actions in response to your inquiries or other Site activities.
  
• Create personalized promotions by combining your personal information with non personal information about you, such as the amounts and types of purchases you make or any benefits you receive through our programs.
  
• Communicate with you about your orders or purchases, your services, accounts and program participation, a contest or sweepstakes you have entered, and your requests for information.
  
• Communicate with you about our brands, products, events or other promotional purposes, including co-branded offers and affiliate and partner offers in relation to food and beverage and catering services.
  

The data that we collect from you may be transferred to, and stored at, a destination outside Hong Kong. 

Does SOL Committee Share Personal Information or Information of Others that you provided with Third Parties?

SOL Committee shares your personal information or information of others that you provided in limited ways:

• We may share personal information about you with others with your consent.
  
• We may share information with SOL Committee’ subsidiaries and licensees and other affiliated companies.
  
• We may also share information with companies that provide support services to us (such as credit card processors or other payment services providers, mailing houses or website hosts) and that help us market our products and services (such as email vendors). These companies may use information about you to perform their functions on our behalf.
  
• We may disclose specific information (i) upon lawful request, in response to legal process, and when required to comply with laws, (ii) to enforce our agreements with you, our corporate policies and terms of use relating to your use of SOL Committee products and services through the Sites or the Services, or (iii) to protect the rights, property or safety of SOL Committee and affiliates, its subsidiaries and licensees, our employees, agents, customers, and others but only when it is reasonable to do so.
  
• If you participate in any blog or other online forum on our Sites, any personal information that you post on our Sites may be shared with other forum participants and Site visitors.
  
• In the event of a merger, acquisition, financing, or sale of assets or any other situation involving the transfer of some or all of our business assets, SOL Committee may disclose customers statistics to those involved in the negotiation or personal information after the transfer.
  

We may also share aggregated or anonymized information that does not directly identify you.

What Choices Does SOL Committee Offer About Personal Information?

SOL Committee offers choices for you to request to access, update or change your personal information and how we communicate with you. Here are some of the ways you can request changes: 

• Follow the opt-out instructions in promotional emails we send you.
  

If you opt out of receiving promotional communications from us, we may still send you non-promotional communications such as emails about your accounts or our ongoing business relations.

SOL Committee will not retain your personal information one year after termination of your SOL Committee Club Card and such information will be erased thereafter. Information of others that you provided will be erased upon the termination of the purpose for which you provided such information.

SOL Committee takes reasonable steps to maintain appropriate physical, technical and administrative security to help prevent loss, misuse, unauthorized access, disclosure or modification of personal information.

While we take these reasonable efforts to safeguard your personal information and information of others that you provided, no system or transmission of data over the Internet or any other public network can be guaranteed to be 100% secure.

Privacy Policy Updates

We may update this privacy policy from time to time. When we do so, we will post the new privacy policy on this page and change the date at the top of the policy. 

We encourage you to check the date of our privacy policy when you visit this Site for any updates or changes. We will notify you of any modified versions of the privacy policy that might materially affect the way we use or disclose your personal information or information of others that you provided.
